Asylum

Asylum is a way for people who are in the U.S. to get protection if they are afraid of going back to their home country because they could be harmed or persecuted. This harm must be due to their race, religion, nationality, political opinion, or being part of a specific group (like LGBTQ+ or another minority).

Types of Asylum

  1. Affirmative Asylum:
    • You apply voluntarily by filing a form.
    • You’ll attend an interview with an officer to explain your case.
    • If denied, your case goes to immigration court.
  2. Defensive Asylum:
    • You request asylum as a way to avoid deportation if the U.S. government is trying to remove you.
    • You present your case in front of a judge in immigration court.
